  Presidential qualification


    The following qualifies for the office of the President of India –


  1. He should be a citizen of India.


  2. He has attained the age of 35 years.


  3. He should not be a madman or a banker.


  4. He is eligible to become a member at the age of sixteen


  5. He should not hold any office of profit under the Government of India or the State Government.


Note – In the Indian Constitution, the President, the Vice President, the Governor and the members of the Council of Ministers in the Center and in the States are not considered as the office of profit.

Presidential electoral college

There is an Electoral College for the election of the President in 54 articles of the Constitution, which includes the following members who vote in the election of the President –

   1. Elected members of Rajya Sabha.


   2. Elected members of the Lok Sabha.


   3. Elected members of the Legislative Assembly of the State.


   4. Elected members of Legislative Assembly of Center Madhya Pradesh Delhi, Pondicherry and Jammu Kashmir.


     Note – Nominated members of the House, December 16 and State Legislative Assemblies and members of the State Legislative Council do not participate in the election of the President.

Election of President of India

         The election of the President is done by the proportional representation system and the single transferable vote system. At least 50 members should be proposers and 50 members should be approvers for the name of the Finance Minister of the President's post. A security deposit of Rs 15,000 is kept for the election of the President. If a candidate does not get 1/6th of the total valid votes, then his security deposit is forfeited.


        If there is any dispute related to the constituencies of the President, it is decided by the Supreme Court. (Article 71)

Method of electing the president

         In relation to the method of presidential elections, provision has been made in articles 55 of the constitution, according to which two principles are adopted in the presidential elections -

        1. Principle of Authenticity and Equivalence - The principle, which is enumerated in clauses (1) and (2) of Accounts 55, shall be uniformity in respect of the representation of the States and equality in the representation of all the States and the Union. This principle is the principle that the same procedure will be adopted for arriving at the value of representation in the Legislative Assemblies of all the States and the sum of the votes of the members of the Legislative Assemblies of all the States will be the same as the sum of the vote value of all the elected members of the Parliament. The following procedure is followed to determine the salaries of the members of the State Legislatures and the salaries of the Members of the Parliament -


    Details of Vote Value of Members of Legislative Assembly - To get the number of votes of the members of the Legislative Assembly of each state, the total population of that state is divided by the total number of members of the state assembly and the quotient is divided by 1000. Thus the quotient is considered as the vote of one member. If, as a result of the respective division, the remainder exceeds 500, one more is added to the number of votes of each member. The fees of the members of the State Legislative Assembly are estimated as follows

        Vote Value of Members of Parliament  - To determine the fees of Members of Parliament, the votes of the elected members of all the state assemblies are taken and the total of the elected members of both the Houses of Parliament participates. The vote of the members of the parliament is as follows -

         In this way, in the election of the President, it is kept in mind that the sum of the salaries of the elected members of all the State Legislative Assemblies should be equal to the sum of the votes of the elected members of the Parliament and that of the elected members of the Legislative Assemblies of all the States. A uniform procedure should be adopted for simultaneous payment of votes. This is called the principle of proportional representation.


        Note:- At present, the base year of the census is considered to be 1971 in the calculation of the President.


          This present system of presidential election is in operation since 1974, which will remain unchanged till 2026.


         The vote value of an elected member of the Uttar Pradesh Legislative Assembly is 208, while the vote value of an elected member of the Sikkim State Legislative Assembly is 7.


         The value of the vote of an MP is 708. There are a total of 776 MLAs in both the Houses of Parliament, out of which 543 are in the Lok Sabha and 233 in the Rajya Sabha.


2. Principle of Single Transferable - Certificate of the principle that if there is more than one candidate among the electors, the nominations by the attache shall be made in order. This means that the voter's polling letter has its own document sequence of the name of the village language or election symbol.


Qualification for re-election

According to Account 57, the person holding the office of the President of India can also be a candidate in the election for the second term. Although the constitution does not provide that the electors can participate for the second term for the post of President or not, but in general it has become neutral that a person is elected only once for the post of President. Oath by the President

         The President, before taking his oath, takes the oath of office of the Chief Justice of India or, in his absence, the senior most judge of the Supreme Court under Article 60.

Presidential term

        According to account 56, the President remains in his office for a period of 5 years from the date of assuming his office, but even before the period of 5 years, he can give his resignation to the Vice President or he may be found violating the constitution before the period of 5 years. Can or can be removed by impeachment acquired by Parliament for trespassing.


        The President continues to hold office even after the completion of his 5-year term, until his successor assumes office.

President's office details

       It has been provided in the constitution that if there is a sudden accident (death, resignation or impeachment) of the post of the President, then the post of the President should be filled within 6 months. Till then the Vice-President in the vacant office of the President or in his absence, will unoppose the President's work and during the sudden arrival of both the President and the Vice-President or in the absence of both, the Chief Justice of India will decide the decision of the President.


Note :- President President Dr. Zakir Hussain died on May 3, 1969, then Vice President V.V. But he resigned from his post to be a candidate for the post of President, then the Chief Justice of the Item of India, Mohd. Hidayatullah contested the post of President unopposed.


        So far three Vice Presidents V.V. Grahin (after the death of President Dr. Zakir Hussain), B.R. D. Jatti (after the death of President Fakhruddin Ali Ahmed) and Mohammad Hidayatullah (due to the absence of Giani Zail Singh) and a Chief Justice Mohammad Hidayatullah have performed the functions of the office of the President.


         Mohd Hidayatullah is the only person who can serve twice as President with the functions of Education - 1. As Vice President (due to absence of Giani Zail Singh) 2. As Chief Justice.

President's salary and other allowances

Free official residence is available to the President. He is entitled to such emoluments, allowances and privileges as may be determined by Parliament by law and until such law is passed by Parliament of his choice and the same as are prescribed in the Second Schedule to the Constitution. At present, the salary of the President is 5 lakh rupees per month, which is charged on the authorized fund or registered fund of India. According to 59 of the accounts of the constitution, the option of the President cannot be reduced during his tenure.


Procedure for impeachment of the President

         The process of impeachment (impeachment) of the President is mentioned in Account 61 of the Constitution. The President can be removed from his office under the process of impeachment of accounts 61. Impeachment of the President is made on the basis of violation or points of the constitution. The impeachment motion against the President is brought in the form of a resolution, which can be introduced in either House of the Parliament. But in the House in which the resolution of impeachment was presented, the impeachment letter by 1/4 of its members was given to the President within 14 days prior to the requirement. A resolution of impeachment can be introduced in the House only after the charge sheet has been given to the President. The resolution needs to be passed by a majority of the membership of the House in which the resolution is presented and a two-thirds majority of the members present and voting. Its resolution is introduced in the other house. The capture of the President of the Second Chamber will be investigated. At this time, the President himself or through his lawyer will give simplification and explanation. If the other House finds the lie to be correct and that House also passes the resolution by a majority of its membership and a two-thirds majority of the members present and voting, the motion for impeachment of the President is deemed passed and the President resumes his office. is forced to resign from

Note :- Till now no motion of impeachment has been brought on any President of India.
