Attorney General of India
In Part 5 of the Constitution and Article 76, provision has been made about the Attorney General. The provision related to the Attorney General has been taken from the constitution of Britain. The Attorney General is the highest or first law officer of the Government of India.
Appointment of attorney general
According to Article 76 (1) of the Constitution, the Attorney General of India is appointed by the President. The President appoints the Attorney General on the advice of the Cabinet.
Qualification of Attorney General
The same person can be appointed by the President to the post of Attorney General, who has the ability to become a judge of the Supreme Court, that is, to become the Attorney General of India, it is mandatory to have the ability to become a judge of the Supreme Court.
Tenure of the Attorney General -
The Attorney General of India remains in office as long as the President wishes. That is, the Attorney General holds his office during the pleasure of the President. It does not have any fixed tenure. The Attorney General can be removed by the President at any time. There is no procedure or ground mentioned in the constitution for his removal.
Attorney General's Salary
The power to fix the salary of the Attorney General is vested in the President. The salary of the Attorney General is equal to the salary of the judges of the Supreme Court, which at present is Rs 2,50,000 per month.
Functions and powers of the Attorney General -
The Attorney General is the highest or first law officer of the Government of India and as such he performs the following functions -
1. To advise the Government of India on such legal matters and to perform such other duties of a legal nature as the President may direct or assign to him from time to time.
2. To perform such duties as may be conferred on him by or under the Constitution or any other law for the time being in force.
3. The Attorney General has the right to be present, to make speeches and to participate in proceedings in either House of Parliament, in a joint sitting of Parliament and in any committee of Parliament in which his name is given. (Article 88) but he does not have the right to vote. At such a time he gets all the privileges of a member.
4. The Attorney General gets the right to appear and plead in any area of India and in any court in the discharge of his duties.
5. The Attorney General gets the right to represent the Government of India in the Supreme Court and appear on behalf of the Government.
Restriction on Attorney General -
Some limitations have also been set on the Attorney General, which are as follows -
1. He cannot defend any person in any criminal cases without the permission of the Government of India.
2. He cannot give any advice against the Government of India.
3. He cannot hold the post of director of any company without the permission of the government.
Note: - The Attorney General is not debarred from private legal practice as he is not a government servant.

Note :- M.C. Setalvad was the Attorney General with the longest tenure, while Soli Sorabjee was the Attorney General with the shortest tenure.
The current Attorney General Mukul Rohatgi is the 16th Attorney General in the country. While this is the 14th person to hold the post.
Attorney General in the Constitution of Indiaeral) The provision of the post has been taken from the constitution of Britain, but there is a major difference between the Attorney General of India and the Attorney General of Britain, that in Britain, the Law Minister is the Attorney General, while in India both the Law Minister and the Attorney General are independent posts. That is, both are different posts, which are held by different persons.
The highest law officer of the state government is called Advocate General. Which is mentioned in Article 165 of the Constitution.
